What happens if my website does not have a privacy policy?

If your website is required to provide privacy information and does not, the consequences depend on applicable law and the circumstances. They can include:

  • Regulatory action: Complaints, investigations, corrective orders, fines, or processing restrictions.

  • Provider action: Restrictions under services whose terms require privacy disclosures.

  • Reduced trust: Visitors may hesitate to provide information when its use is unclear.

There is no automatic, fixed GDPR fine for a missing policy. Regulators assess the infringement and choose appropriate measures. Provider rules are separate: Google Analytics requires privacy disclosures about its use and processing.

If required disclosures are missing, review your data practices and publish accurate information promptly. Doing so does not retrospectively resolve earlier failures to inform people or obtain required consent.
